These Terms and Conditions ("Terms") govern your access to and use of the Collab-One QMS platform ("Service") operated by Suryadeo Enterprises ("we", "us"). By creating an agency account or using the Service you agree to these Terms.
1. Eligibility
You must be at least 18 years old and able to enter a binding contract to use the Service. Agency accounts may only be opened by a person authorised to act for that agency.
2. Accounts
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account, including actions by inspectors and administrators you invite. Notify us immediately at support@collab-one.com if you suspect unauthorised use.
3. Subscriptions & billing
- The Service is billed per agency on a subscription basis. Current plan prices are shown on the pricing section and may change with reasonable notice.
- Subscription fees are billed in advance and are non-refundable for the period already commenced, except where required by law.
- Taxes (including GST) apply as required by Indian law.
- Non-payment may result in suspension of workspace access; your records remain retrievable for a reasonable grace period.
4. Acceptable use
You agree not to:
- Upload content that is unlawful, infringing, defamatory, or violates any third-party rights.
- Attempt to reverse engineer, probe, scan, or compromise the Service.
- Use the Service to send spam or unsolicited communications.
- Issue, alter or backdate inspection certificates other than as a duly competent person entitled to do so.
- Impersonate another person or misrepresent your affiliation or statutory approval.
5. Your content
You retain ownership of the inspection data, photographs, signatures and certificates you upload or generate. You grant us a limited licence to host, process and display that content solely to provide the Service. You are responsible for the accuracy of every certificate you issue and for ensuring you hold the rights to any content you upload.
6. Statutory responsibility
Collab-One QMS is a record-keeping and workflow tool. We do not perform inspections, do not certify equipment, and are not a competent person under the Factories Act, 1948 or any other statute. Responsibility for the technical correctness and statutory validity of every inspection and certificate rests entirely with the issuing agency.
7. Service availability
We strive for high availability but do not guarantee uninterrupted or error-free operation. Scheduled maintenance and unforeseen outages may occur.
8. Disclaimer
The Service is provided "as is" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by applicable law, Suryadeo Enterprises shall not be liable for any indirect, incidental, special, consequential or punitive damages, or loss of profits or revenues. Our aggregate liability arising out of or relating to the Service shall not exceed the amounts you paid to us in the twelve months preceding the claim.
10. Termination
You may close your account at any time. We may suspend or terminate access for violation of these Terms or where required by law. Provisions that by their nature should survive termination (billing, liability, disputes) will survive.
11. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance.
12. Governing law & jurisdiction
These Terms are governed by the laws of India. The courts of New Delhi shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Service.
